TERMS AND CONDITIONS

This document (along with the documents mentioned herein) constitutes the terms and conditions to enroll with the LaLiga Football Schools Open for All Coach Education Programme, which shall be supplied to you by LaLiga Football Schools (‘Course’). Please read these terms and conditions carefully before proceeding with the Course. By proceeding with the Course, you agree to be bound by the terms and conditions mentioned in this document and any other document to which reference is made herein.

1. INFORMATION ABOUT US

LaLiga Football Schools are operated by IOT Sporting Aspirations Pvt. Ltd. (‘We’, ‘Our’, ‘Us’). We are registered at Unit No. 4, Ist Floor, The Centrium, Phoenix Market Mall, Off LBS Marg Kaman I Junction, Kurla (W), Maharashtra Mumbai - 400070 and have our corporate office at 28/13, First Floor, Main 60 Feet Road, Near ICICI Bank, St. No. 14, Vishwas Nagar, Shahadra, New Delhi - 110032.

2. YOUR STATUS

By registering for the Course(s), you warrant that:

(a) You are legally capable of entering into binding contracts; and
(b) (1) You are at least 18 years old; or
(b) (2) A parent or guardian has entered into the contract on behalf of the participant.

3. REGISTRATION PROCESS

When you register for a Course, the contract between IOT Sporting Aspirations Pvt. Ltd. and you shall come into force when we accept your registration (‘Contract’). Please note that participation or enrolment in any Course is subject to availability. No payment of fees shall be received without enrollment into a Course. Notice of a confirmed enrollment will be sent to you by email where possible, as soon as details of your payment have been processed and entered into our system. The Contract will relate only to the Course.

4. PRICE AND PAYMENT

The price of the Course shall be INR 2500 inclusive of all taxes. Payment for the Course can be made by using the UPI barcode or online bank transfer.

5. THE COURSE

The Course shall be a six day course (14th December to 19th December, 2020) which shall have a ninety (90) minutes session every day in the evening. The Course shall be hosted on Zoom. We treat as a priority, the safety and well-being of all the participants attending the LaLiga Football Schools Open for All Coach Education Programme. We reserve the right to remove from the Course, any person, who is found to be engaging in offensive activity, the bullying of others, disruptive behaviour or for any other reason where we consider a person’s behaviour is detrimental to the interests or safety of others. In the event of removal from a Course for any disciplinary reasons, no refund of any fees paid shall be made.

6. ATTENDANCE 

It is mandatory for each participant to attend all sessions conducted in the Course. No recording of the sessions shall be provided to participants who fail to attend a session. In the event a participant is about to miss a session due to an emergency, the participant shall, prior to the session, by way of email, inform us about his/ her inability to attend and the reason for the same. Only in such a situation where it is deemed appropriate, will a recording of the session be shared with the participant.

7. DATA PRIVACY, INTELLECTUAL PROPERTY AND CONSENT

At the time of registration with us, certain confidential information about the participant shall be required to be provided to us. Please note that the same shall be kept confidential and only used by us to reach out to you for (i) providing information in relation to the Course you have registered for, (ii) providing information for other courses of IOT, and (iii) follow up or correspondence in relation to your activity related to IOT.

Since the LaLiga Football Schools Open for All Coach Education Programme (“Program”) is an online course, please note the following:

1) We are the sole owner of the Program and all intellectual property thereof including any video / photograph of the same;
2) By registering with us for the Course, you permit us to record / screenshot the Program and for this purpose, grant consent to IOT that the participant’s imagery/ photograph/ presence may be utilised as part of this record/ screenshot of the Program;
3) You or any affiliate thereof are not permitted to record/ screenshot the Program and utilize the same in any manner other than for your personal training requirements; and
4) We shall be entitled to utilize the said recordings or photograph of the Program in any manner deemed fit by IOT.

8. TRANSFER OF RIGHTS AND OBLIGATIONS

You may not transfer, assign, charge or otherwise dispose of a Contract, or any of your rights or
obligations arising under it, without prior written consent from us. IOT reserves the right to transfer, assign, charge, sub-contract or otherwise dispose of a Contract, or any of our rights or obligations arising under it, at any time during the term of the Contract.


9. NOTICES

Other than notices as mentioned under Clause 6, all notices must be communicated to IOT Sporting Aspirations Pvt. Ltd at legal@indiaontrack.in. Notices will be deemed received and served 48 hours after an e-mail is sent.

10. EVENTS OUTSIDE OUR CONTROL

We will not be liable or responsible for any failure to perform, or for delay in performance of, any obligations under a Contract that is caused by events outside our reasonable control (“Force Majeure Event”). A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:
(a) Strikes, lock-outs or other industrial action;
(b) Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether
declared or not) or threat or preparation for war;
(c) Fire, explosion, storm, flood, earthquake, rain, epidemic or other natural disaster;
(d) Impossibility of the use of public or private telecommunications networks; or
(e) The acts, decrees, legislation, regulations or restrictions of any government.

Performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues. We will make reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which the obligations under the Contract may be performed despite the Force Majeure Event.

11. ENTIRE AGREEMENT

These terms and conditions, the booking form and any other document expressly referred to in
them represent the entire agreement between us in relation to the subject matter of any Contract and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing. These terms and conditions can be altered or changed at any stage by IOT.

12. LAW AND JURISDICTION

Any dispute or claim arising out of or in connection with the above or their subject matter will be governed by Indian law. Any dispute or claim arising out of or in connection with the Contract or their formation (including non-contractual disputes or claims) shall be subject to the jurisdiction of the courts of New Delhi - India.
